Kwara State High Court has dismissed a lawsuit filed by Artee Industry against the Kwara State Government concerning a parcel of land located at Unity Road, Ilorin, the amusement park.
The judgment was delivered by Hon. Justice Nureni Kuranga, who ruled that the case lacked merit and substance.
The claimant, Artee Industry, had instituted the legal action on October 7, 2021, seeking an injunction to restrain the state government from entering or making use of the land covered by Right of Occupancy No. KW 17223, measuring 4.371 hectares and situated along Wahab Folawiyo Road, Ilorin. The claimant also requested a court declaration that the government’s entry onto the land, erection of signposts, leasing activities, and tree felling amounted to acts of trespass and nuisance. Additionally, Artee Industry demanded N200 million in exemplary damages.
However, Counsel for the Kwara State Government argued that the claimant did not possess a valid title, having failed to fulfill the terms and conditions attached to the provisional allocation of the land. The court agreed entirely with the defense and resolved all issues in favor of the State Government.
Justice Kuranga held that the claimant was not entitled to the land in question and accordingly dismissed the suit.
This ruling reaffirms the position of the Kwara State Government in matters of land administration and legal compliance.
